Problems with Defamation of Character Lawsuits

The fact is, that even in the court it is rather difficult to envision the difference between the actual defamation of character and "normal" domestic argument or comment. The problem arises because both of them - a defamation of character and a domestic argument - tend to over-lap one another. And nobody argues that a domestic argument can develop into a serious defamation of character.

In the USA, every state has its own legal provisions in the Civil code regarding the defamation of character lawsuits. Here are some explanations dealing with the concept of defamation of character.

The principles of democracy proclaims that self-respect is a primary human right. Defamation of character may violate it by the means of slander or libel. Slander is a statement or a set of statements which are spoken with an intent to attack a self-respect of a person or ruin a person's reputation. A libel is a statement of the same nature, however, it appears in written or illustrated form. Acctually, these statements, either spoken or written, are insults, defamatory proclamations or declarations about a person or an organization, and could be true or untrue. In case of a defamation of character lawsuit, a slander or a libel has to be either untrue or unwarranted.

Some slander and libel, are considered defamatory even though they are true. For example, if a person refers to a fatherless child in a derogatory manner it is considered to be a defamation of character. The same is with an insult regarding homosexual orientation of somebody. That is why, the law or the decision of the judge or jury may differ upon the truthfulness.

So, if you are going to fill a lawsuit with the court of law, there are a lot of things that have to be thought through and discussed with your attorneys, as every defamation of character lawsuit is tricky and there are chances that being innocent you may lose the case or the case may not even go to trial.
