Rape & Punishment

Rapists Should Suffer

C.R. Rockwell
The punishment for rape must be increased. As it stands right now, according to the National Center for Policy Analysis, "anywhere in America, if a man rapes a woman, he should only expect to serve a prison term of 128 days." When you consider the years of shame, false guilt, post traumatic stress disorder, possible pregnancy and thoughts of suicide that a victim of rape goes through, 128 days of free shelter and food hardly seems fair or just for the rapist. The punishment simply does not fit the crime. It is understandable that there is prison overcrowding. It is understandable that unless reported immediately, rape is hard to prove. It is understandable that there are situations where women have reported a rape falsely and ruined men's lives. Most of these problems are valid problems in and of themselves that need to be solved another time. Our goal in America must be to have a firmer grasp on the brutality of rape and to create a punishment that truly fits the crime.

We must begin mandatory castration immediately after the conviction of rape (walk them out of the courtroom and into the operating room). The perpetrator must have a surgical implant, preferably done during the castration surgery, to track his every move for the rest of his life (not unlike a GPS system) and last but not least, the average prison sentence for rape must be at least triple what it is now. It is my experience that people will inherently do whatever they can get away with. People need to be terrified of raping another person. When the punishment is not worth committing the crime, people will stop committing the crime.

Mandatory castration immediately after conviction of rape will have several effects, the first of which is that rape will be associated with castration, which is not a pleasant thing to associate any action with. The second effect that it will have is that it will forever inhibit the perpetrator from committing the same crime. Furthermore, it will alert anybody who decides to have any kind of a romantic relationship with the perpetrator in the future that this person is, or has been, a rapist.

A surgical implant, the type of which have been talked about for years as being everything from "the mark of the beast" as some Christians believe it to be, to something akin to a fingerprint, to be used by law enforcement officials is absolutely necessary. Having searched meganslaw.com, attempting to find sex offenders in different areas of California, it has come to attention that there are many sex offenders that simply disappear. Law enforcement officials don't have their current address. These sex offenders never checked in the last time they were required to do so. If they all had these implants, there wouldn't be any checking in. Californians, as well as law enforcement officials, would know where they were at any given time. This would cut down the number of unsolved sexual offenses, it would help law enforcement find sex offenders who might be trying to evade them and it would keep our streets safer.

The average prison sentence for rape must be tripled throughout the United States. The average prison sentence right now is four months. Tripling that, making it 12 months, or one year, does not even seem to come close to what is deserved by the kind of person who could perpetrate a rape. To allow somebody who is capable of forcing himself inside of somebody else, out of jail on "good behavior" is insanity. We must not treat prison inmates as though they were children who didn't do their chores. Prison inmates should not be let out to play with the rest of us, just because they're good at acting like they're one of us. That is precisely the kind of person that must stay in prison. The kind of person who is capable of acting like a gentleman, and is capable of, at the same time, planning to rape his neighbor's thirteen-year-old daughter, is the most dangerous. He must be punished, not praised. He must be looked down upon, not let back into America's society.

I completely support castration as long as it is carried out with ample time to prove innocence and used appropriately. Castrating a husband because his wife claims rape could be a tricky dilemma. The crime would have to be deliberate and proven. Rape is far worse than murder as death is once and over. Watch any TV episode about addictions and see how many of the women were sexually abused. The pain is usually horrible and lasting. Though the U.S is a great country, we are blinded as a nation to be politically correct about everything we do, including in the way we handle our murderers, rapists, and child molesters. Though everyone I meet and talk to about this topic supports it in some shape or form, it does not mean anything if there are no large protests/groups pushing the matter daily. To be frank, we're lucky enough to still have capital punishment (though it's not used quickly enough). Castration is a battle far far far away. For now, effort is better spent at overturning

I agree, however as it stands now such changes won't come for a while. With the economy like it is, so many people losing jobs, and even then america is still putting so much money into foreign affairs. Many in congress don't care enough to push that sort of change into law. A large enough movement of people pushing for such laws might actually be able to get it done, but often times the victim doesn't want others to know, and the longer this goes on the less likely change will ever come. Only a few spoken voices can't do much but if they can gather more then they will be able to really bring change and keep things like rape and child molestation from ever happening again.

You are right rape is pushed to the back burners as a lesser crime and the punishment should make the crime worth not doing but like you said some women do falsely acuse men and therefor the punishment should not be castration or capital punishment. Untill it is proven 100% that the rapist is guilty then that should be the punishment.

Can't agree more. Rape is sometimes worse than murder. The punishment should deter the perpetrators and make the crime not worthwhile considering the consequences. On the other hand, we live in a society where rapists and child molesters are freed after a short sentence, allowing them to violate more innocent female adults and children.

The punishment should be castration or capital punishment. So much for freedom and equality! Women are still the primary underdog. This needs to change. The punishment should deter the criminals. If not, the justice system is a failure.

I think people jump too many conclusions. As if the justice system is a fair one. People get accused and because everyone automatically thinks that you are guilty. You get found guilty before the case is heard. Now the man who any woman at any time can accuse with out evidence life is ruined. Men have rights to stop believing because she is a woman she is automatically right. Rapes do happen but this had become a witch hunt.

O also to any dammed fool who believes that a rapist does not deserve death and that the result of a rape to a women is not as severe as death, let me tell you one thing; when a female is raped they are not only stripped of their physical mortality, but their very being and spirit is torn from their existence or at least a massive part of it. The shame and nightmares that such an event brings to a female is 1000000000000 times more severe than death; and many women who are raped desire death over living the nightmare they must endure after a rape so don't you think for even a second that death is too severe for a rapist, for that very train of thought is what keeps rapists on the loose.
"There are far more worse things than death in this world"

These or (I can think of many other fitting punishments) other gruesome punishments would easily hinder rapes much more than our current punishments and are nowhere near as terrible as what a rape does to a female.

Also to prevent false accusations of rape, if a falsely accused man is punished from one of these punishments and it is later found that he was innocent, the accuser should have the same punishment applied to them; I can guarantee that these set rules I have mentioned would drastically prevents rapes from happening.
I am saying these words as how and what I would want if my own sister was raped and I completely believe that with these rules along with the correct bringing up of families with good morals would make rapes something unheard of in do time.

  • Zero7/21/2009

I completely agree that the current punishment is only encouraging rapes to happen because of it's inefficiency. Personally I think that if a rape can be proven, the victim or victim's family should be able to choose one of the following punishments (and no these are not anywhere near as severe as what the victim experiences) 1. the easiest "Death sentence" 2. second easiest "Surgical implant of a tracker into their bodies and the branding of their foreheads to mark them of their sick past" 3. probably the most fitting punishment "Poking out their eyes and cutting off their ears along with branding their foreheads in-order to forever put them into the same darkness that they placed on the victim if even a little."
Finally in the likely event that a rapist dies from one of these punishments, because they are not even worth giving a burial for, their bodies should be hanged on a tree for the crows to eat in order to further disgrace their very lives just as they did to the victim.

To the user who commented about a "40%" rate of false claims, that number is ridiculously inaccurate. I've done research for numerous articles over the past few years and time and time again we see that the rate of false claims is exactly the same for all other crimes, at about 2%. Idiot.
