Insurance
When you buy your cell phone you are often offered insurance along with the phone. This is roughly a five dollar fee that is tacked onto the bill every month. It covers if your phone is damaged in any way, so if you phone begins to act up or stops functioning properly you will be able to go into your wireless provider's store and show them the problem. Make sure to read over the fine print of the policy, because like other insurance policies, they may try to give you a used phone of the same model or even a completely different phone. The replacement phone will either be given to you in the store or via mail. The mailing process can often take several days, all of which you will be without a phone.
In Store Purchase
Many people do not opt for the insurance policy and run the risk of paying for a brand new phone if it is damaged of destroyed. If this happens you need to go into the store and describe what happened to your phone. If the problem is caused by the phone malfunctioning on its own you may be entitled to a new phone without insurance, due to the damage not being caused by you. However, if there is water damage or if it is found that the damage is user related, you will need to purchase a new phone from the store if you want to continue receiving calls.
Online
If you know you will have to purchase a new cell phone and don't want to deal with the individuals at the store, try buying the phone online. The company website (such as Verizon, AT&T and Sprint) will all have specific phones showcased on their site. There may even be special online deals at the time. You can also try to purchase the phone from the manufacturer. If the phone is made by Motorola you can go directly to the Motorola web site and buy the same phone from there. The site may even have newer phones that your wireless store hasn't started to provide (next to every phone it will state what wireless carriers can use the phone).
