A Court Case Against Scott Lowery Goes Unresolved - and Its Their Fault!

After Scott Lowery, a junk debt buyer, took me to court, the judge ordered them to pay my gas mileage. Yet, to this day, they refuse to pay me the measly pennies on the dollar that's due. Will a new court case against Scott Lowery be necessary?

You might be asking, "So what happened in the first place?" Let me give you the short short version of the story, to bring you up to date.

In 2007 I had a credit card account. I had a bad car wreck, lost my means of income, and defaulted. Eventually Scott Lowery bought my debt then attempted to collect it. I asked for proof of debt ownership, validation and verification of debt, but Scott Lowery refused -repeatedly. Finally, after two years of my requests for validation and their refusals, they sued me.

Now for the details...

The court case was originally scheduled for September. I attended. They did not. The judge said it was a "preliminary hearing," and therefore, the other party was not required to appear. However, if I had failed to show and they chose to come, which would be their prerogative, I would have lost by default.

The hearing was set for January 2011. I attended. Again, they did not. Interestingly enough, the night before the court hearing the blizzard of 2011 hit Oklahoma. Knowing this storm was on its way, I drove the 23 miles to the county seat the day before, stayed in town, and was slip-sliding my way across town to the court house on time, as scheduled. I was ready and waiting for the hearing an entire hour before it was scheduled. The Scott Lowery team, however, did not have the common courtesy to alert the court or myself of their intentions to reschedule. Instead, a representative from the Tulsa branch of the Scott Lowery law firm called the county court clerk at 10am on the dot - and I do mean straight up 10am - the time of the court hearing.

Frankly, I was as appalled then as I am today. I had traveled in extreme weather conditions in order to attend a bogus court case, and the other party couldn't even have the common decency to let me know that they would not be in attendance? Seriously?

Now, under normal circumstances, the case should have been dismissed then and there, in my favor, because the other party failed to appear. However, due to the extreme weather, the original judge could not make it to the court house that day. An alternative judge handled my case instead. The judge issued a court order against the Scott Lowery law firm, ordering them to pay me for my gasoline. Hardly a slap on the wrist, considering that I had to risk my life to make it back home.

A month after the order was issued, I had yet to receive any payment from Scott Lowery. I called the court clerk to inquire about the reasoning behind the delay. "You have to send them a bill," the clerk told me. "Just write out a letter or something and tell them they owe you however much money it is, and send it to them."

I followed the clerk's advice and, about a week later, received a check in the mail. Unfortunately, however, Scott Lowery did not pay me what was rightfully due. Instead of calculating my mileage by measuring the distance from my house to the court house, they measured based on zip code instead.

When I called their office to explain that the court ordered Scott Lowery to pay me exact mileage, based on the current state rates, they laughed and said, "Well, we pay based on what our computers say we have to pay. We aren't paying any more."

To this day, the Scott Lowery Law Firm still owes me about $7.00 in court-ordered gasoline reimbursement. Will they ever pay me? Doubtful. That is to say, unless I take them to court and request a hearing - which in turn will cost me way more than the $7.00 that is due. Is it worth it? I don't know. But it seems to me that, after two years of harassment and bullying, the least they can do is give me such a measly amount!

Is the $7.00 too petty to mess with, or is it the principle of the matter? Should Scott Lowery have the right to forget its court-ordered debts, simply because its debtors can't afford to stand up for themselves?
