Snooki Trademark Rejected

Nicole Polizzi's trademark application to write a series of books using her famous nickname, Snooki, from the MTV hit show, "Jersey Shore," has been rejected, because of an already existing trademark using the same name although spelled a bit differently -- Snooky with a Y -- just as I predicted back in February 2010, in my article "Snooki Trademark Conflicts:"

"There is an existing trademark in the class she applied for (IC 016) for The Adventures of Snooky, a series of children's books, owned by the author, John Monaghan. Snooky is a cat and according to one reviewer: "Snooky is a good role model for children."

Reports are that Snooki can appeal and try to prove that her books don't conflict with or will not infringe on the Snooky the Cat series, but it probably won't get her anywhere fast. Where is her first book? So far, the only book out on the Jersey Shore crew on Amazon is "Gym, Tanning, Laundry: The Official Jersey Shore Quote Book," authored by MTV, not Snooki. Snooki will have a hard time successfully defending her application to trademark a series of books unless she already has at least one out there.

Of course, as I also said in the same article, she has a pretty good chance in the other class she applied for a trademark in: "Even if Ms. Polizzi's application in IC 106 is unsuccessful, she may still have a chance in IC 041 (good and services: entertainment, in the nature of a television personality).

Maybe Snooki should just 'fuhgeddabout' the books. Why does she really even need a trademark? That is the question.

On Zazzle, a leading print-on-demand merchandiser online, Jersey Shore opened its own store and successfully got all other tee-shirts and merchandise with names similar to Snooki and other show characters taken down.

By the time Snooki gets a trademark, the popularity of her show may very well be on the wane. Snooki will just have to engage in more wild and crazy antics to keep her star shining. From the looks of things -- getting drunk on the beach and locked up in the drunk tank in Seaside Heights this past July, she's off to a good start.

    There are so many reasons to reject a book written by Snooki, the least of which is a trademark infringement. LOL
