Suit Filed Against Anna Nicole Smith

Rita Crosby reported on MSNBC's Joe Scarborough program that Anna Nicole Smith has a drug problem with Methadone. This is according to Larry Birkhead who claims he is the father of Smith's daughter Dannie Lynn Hope. Birkhead also claims Anna Nicole Smith was pregnant previously with a child of his, but miscarried.

Birkhead tells MSNBC's Rita Cosby he has filed suit against Anna Nicole and wants a DNA test. Birkhead has retained Celebrity Attorney Debra Opri to represent him. According to Opri, Birkhead "seeks truth in paternity as he believes beyond any doubt that he is the father and seeks a presence in this child's life. He is concerned for the health and safety of the child based upon drug issues and manipulation by a third party for purposes contrary to the interests of the child." She went on to note that her client is "responding to the 'circus-like' atmosphere with Howard K. Stern as ring leader this past week wherin serious and false allegations that Stern is the father were made and many defamatory remarks about Mr. Birkhead needed to be addressed."

Last week on Larry King, Smith's Lawyer, Howard K. Stern said that he was the father of Nicole's daughter and that it had been kept a secret because of his position as her lawyer. Although Stern will not take a DNA test to see if he is the father. He says because of the timing both he and Nicole know that he is the Dannie Lynn's father.

In an interview with the Insider, Anna Nicole Smith's, Mother Virgie Arthur she reported that she couldn't make sense of what she was saying on the phone. She says, "She was so drugged up, I imagine... She was so medicated, I think, I could not understand a word, other than, 'Danny's dead.' "She was crying, and trying to talk and mumbling - you couldn't understand hardly anything she said. And as soon as she said that, the phone went click, so I don't know if she hung it up, or if somebody else hung it up for her."

Arthur has been devastated by the tragedy because she claims she raised Daniel until he was six, while Anna Nicole searched for work. She's still puzzled as to why she was cut out of her daughter and grandson's life, but she has her thoughts about what has soured the relationship. She is urging her daughter to call her again. Smith's mother fears her daughter Nicole is in trouble because she hasn't buried her son and has had a wedding ceremony.

According to All Headline News, Smith says reports that she married her attorney/lover in the Bahamas are false. Smith says she participated in an officiated "commitment ceremony" aboard a luxury yacht in the Bahamas. The event occurred while Smith's son, Daniel, awaited burial at a funeral home after his mysterious death, weeks earlier. According to MSN, a spokeswoman for Trimspa, the diet supplement endorsed by Smith, said: "In search of solitude, they set out on a clandestine sail to recapture simple pleasures - fresh salt air on the face, a sunrise on the ocean, and wind in their hair.
