Tammi Smith is Out of Jail on Bail; She Discussed the Experience

Tammi Smith was released from 4th Street Jail around 4am MST on Wednesday February 3 2010 after she was just put in jail the day before in connection with missing Gabriel Johnson, who turned nine months on this day. Jack Smith, her husband, had paid $1,500, which is 10% of her $15,000 bond- the rest of the money was put up by a bail bondsman, for whom Jack Smith put up the Smiths' home as collateral.

Jack and Tammi Smith crossed the street to meet the news media. Tammi wore a warm coat, with small tears in the back. The morning twilight was dark but the news media lights were bright. As Tammi backed away with a smile, she said, "So bright." She asked for a few moments to collect herself and then mentioned she'd had no food or drink since Tuesday morning and was so dry that she could barely speak.

A reporter asked Tammi Smith about her experience inside the 4th Street Jail. "It was really cold, it was really cold. Sitting on 'cement' basically the whole time. So sad for all those people in there," said Tammi.

As Smith had entered jail on Tuesday February 2, she had said she was innocent. A reporter asked her if she still took that stance. "Of course, absolutely, yeah," said Tammi. The charges on her are Conspiracy to Commit Custodial Interference, Custodial Interference, and Forgery. "Those are charges that the Tempe Police Department are trying to create a case with. Because of the whole criteria thing, by law, they could arrest me doesn't mean those charges are gonna stick- doesn't mean those charges are true. But nevertheless they were able to do that because they were the guys with the guns," stated Tammi.

Tammi Smith criticized the Tempe police and their so-called evidence against her. "They released a paper that was full full of things that I can't even describe it. It was ridiculous. It's basically like cutting and pasting little pieces of things together but forgetting this and this and this to prove my innocence. It was unbelievably ludicrous," said Tammi. She said that it was okay though and added, "We have all of those pieces to fit back in there that creates all of our innocence."

Tammi discussed why she had become involved with the mother of Gabriel, Elizabeth Johnson. "I felt very, very sorry for her- that she had nobody on her side," said Tammi. When asked if she knew where Gabriel was, she said, "No. Absolutely not." She discussed the recorded conversations and text messages that she and Jack had exchanged with Gabriel's father, Logan McQueary and that the Tempe police had requested from Logan. She alleged they had been doctored. Jack agreed with her.

When asked if the arrest was a scare tactic to get her talk, Tammi said, 'Yes'. She was also asked if she was badgered. "Yes, at the Tempe police station," said Tammi. Jack reiterated that he and Tammi had been open and honest all along. He blamed the police's poor questioning ability as to why important details were overlooked and cited the Craig Cherry incident.

Tammi Smith said she is relieved that Jack is no longer a person of interest because he will be a great credible witness for her in court. She swiftly added she had many great credible witnesses, including a few attorneys. She derided the prosecutor's witnesses. "They have Logan as their witness. Let's see who else they have... they have Deanna _____ as a witness. And we're going to tear them apart. Well, I'm not. My attorney's going to tear them apart," stated Tammi matter-of-factly.
