As our Constitution was written by largely British ex-patriots, all 'common law' references with respect to civil and criminal citizen conduct are based by inference in the 10 Commandments and enumerated added Bill of Rights protections first and foremost. Thus, our 'right' to bear arms was included for just such self-protection, against or for the government if necessary in service to our country, and if it ever become necessary against an unconstitutional government compromising those rights, freeds or liberties and protection of our property against citizen violators who also threaten our lives and/or property. The right to protect your life and personal property is basic under that Constitution and founder's beliefs and intent as a 'natural law' and given.
Now in the aftermath and hysteria of 911, we have the 'Patriot Act,' a violation of the most basic rights and freedoms protected in the First Amendment. Instead of Constitutional defensive protection and border security after an attack which was perpetrated from within by extended visa foreigners, we have an Act violating one of the most basic rights any American has under that Constitution - the right to freedom and protection against unlawful search and seizure in their private affairs and person without 'just cause or warrant.' It appears also each and every session with 'pork' bills and 'budget' requests, instead of reducing the tax burdens unlawfully imposed, those on Capitol Hill keep creating more sources of revenue and ways to spend it. Our government can't live within it's own budgets (since there is no bottom line budget at all with it's propensity to call on the Federal Reserve it created to print more cash, inflate and depreciate our dollar, in their deficit spending and expenditures). Instead then of bankruptcy protection when it's citizens have reached their limit, our government has basically also removed this Constitutional protection since, bottom line, the buck doesn't stop at the President or Congress, it stops with the citizens since it is their money they are entrusted with and spending.
Fast forward to 2007, and this country is in worse condition with respect to lack of accountability, revenue imposition and collection and claimed sovereign immunity than Ben Franklin could have ever imagined.
With respect to the tax issues and other property rights violations which are occurring, imagine for a few moments you were a member of the First Constitutional Congress. Under our Constitution, our federal government as a sovereign nation with respect to the other nations of the world, is given the ability to tax in order to carry out it's limited and enumerated powers. It's compensation and revenue, up to the passage of the 16th Amendment was the revenue gained from trade agreements, taxes imposed in the regulation of commerce (remember the fear of corporate dominance was clearly anticipated since the founders had experienced the East India Tea Company's taxation and favored status with King George), excise taxes, and taxes on property held by landowners - not personal or direct taxes against it's citizens, but indirect taxes (with citizens then free to choose whether to pay the tax in the use or purchase of the item taxed). In not taxing 'income' but 'consumption' inherently those 'consumers' who were wealthy would justifiably carry a heavier tax burden than those not so fortunate, but also would be the benefactors in most of the foreign trade agreements indirectly or directly. This also protected American industry and trade, and generated the revenue for our government to function. Now we have NAFTA, an attempt to unionize our country and it's economy with other nations 'for the greater good,' a not sovereign and independent Constitution based nation but an attempt to move toward global socialism or a One World Government.
Would the founding fathers have envisioned this? Don't think so.
The citizens in our country are now subject to increasing taxation and unlawfully levied federal, state, county and municipal taxes at an unprecedented level, and seizure of their property now through lack of banking regulation and unconstitutional transfer of it's governmental powers to a private entity, the Federal Reserve, almost at will mostly for bank profits and/or the 'global' stock market economy. Unencumbered land now is almost non-existent in most areas of the country. With the Kelo eminent domain decision (a decision rendered without a civil jury trial in order for Ms. Kelo's peers to define 'public use' rather than our out of control Supreme Court), land and homes are now up for grabs to whomever will generate the most added tax revenue for the local, state or federal government or their 'agents,' the politicians who rob from their fellow citizens for their corporate clients in order to stay in office.
The Constitution, last time I checked, did read 'We the People,' not 'We the Corporations,'and the 'greater good' nor is 'jobs and the economy' anywhere to be found within that document or included in the Bill of Rights.
Seems this election year with the dissatisfaction in Washington and even at the local level running rampant, appears simply another 'changing of the guard,' rather than real change, with just an change in the "Board of Directors" and primary corporate industry who will be in charge for the next four years for the finalization of the unionization and New World Order. Our involvement in the Middle East obviously for the needed oil to bring it to fruition, and the border remaining unsealed for the illegal cheap labor that will be necessary to circumvent the unions and skilled tradesmen for the merger (remember the imported Asian labor brought in to build the railroads in the late 1800's?).
George Orwell was a few years off, but quite obviously it appears those in Washington are reading his books, rather than the founders legacy - the Constitution.

Post a CommentRegarding the above, the article was not titled 'Income Taxes' and the Constitution - but an overview of where we WERE as to the founder's intent in this nation, and where we are now. The Constitution is not being interpreted nor legislated with the founder's clear intent in mind of a limited federal government, and protection of citizen's rights of unlawful property seizures - be it real property, or money - without the consent of the governed - not the 'corporate' good nor 'general welfare' at all.
Agree with some of the information contained in the articles referenced, but alas, not all - but the article on the corrupted judicial and political judiciary is very good, and mostly on target from my experience working within the field.
