People not familiar with the process generally believe that they can't file a claim with the other party's insurance. Anybody can file a claim on anyone's insurance; it is up to the insurance to investigate and decided the validity of the claim. Don't assume that the other party will be forthright and file the claim on their own, this rarely happens.
One of the biggest mistakes made consistently by drivers after a car accident is that they don't file the claim as soon as possible. This is a very important part of the process as a whole, the longer you delay filing the claim the longer it is going to take to conclude the claim for the insurance provider. Insurance companies have deadlines and state insurance laws to deal with that make them operate on a timeline. The longer you take to file, the more delayed the start to that timeline will be.
Getting the other party's insurance information is the most vital step in guaranteeing a successful resolution to the car accident. However, many people believe once you do that there is nothing else left to do. This couldn't be further from the truth. What you should do is file a claim with the other party's insurance as soon as is humanly possible. Don't do it while talking to the police at the scene, this will agitate all parties. Do it as soon as you get home or back to work, etc.
If you feel like the accident was not your fault and you can drive your vehicle home, drive home and file the claim as soon as you walk in the door. Don't file the claim with your insurance first, do it with theirs! If their insurance accepts responsibility then they will pay for everything without you having to pay a dime.
There are no guarantees after the car accident is over; nobody knows when the claim will be concluded and when your repairs will be started. Make no mistake about it though; you will not get anywhere until you file that claim!
