There are numerous benefits our Criminal Justice system has gained as a result of the Miranda v. Arizona case that took place in 1966. The Miranda case is said to have changed landscape and the way our criminal justice system operates in a positive fashion. The Miranda Warning offers all individuals the protection of our 5th and 6th Amendments. Before any interrogation-custodial interrogation can transpire by a law enforcement official, all individuals suspected of being involved in a crime must be read their Miranda warning by a law enforcement officer.
A law enforcement officer will explain to the individual that he or she is guaranteed a protection of our 5th Amendment Right against self-incrimination by stating to the individual he or she has a right to remain silent and anything said can be used against that individual in court. Furthermore, the Miranda warning informs the individual they are protected by our 6th Amendment Right to counsel. This in return informs the individual an attorney will be provided to them even in the event one cannot be afforded by the individual.
Moreover, the Miranda Warning has increased professionalism throughout our criminal justice system, amongst law enforcement officers and law enforcement departments across the United States on the federal, state and local levels as each recognizes the importance and key components the Due Process of Law has to offer when conducting investigations and so forth. In addition, the Miranda Warning has alleviated a great deal of illegally obtained evidence and confessions obtained by law enforcement officials, due to the fact it has removed coerced and forced testimonies from witnesses and suspects.
This in return, has allowed prosecutors the opportunity to build-establish stronger cases which have led to an overall increase in convictions and plea bargains. Additionally, it has prevented innocent parties from being wrongly convicted due to legal corruption or law enforcement error. I believe the Miranda Warning has also offered a great deal of protection to individuals who are unfamiliar with our country, such as immigrants, both legal and illegal. This has rendered a vast majority of confessions to be reliable and trustworthy.
