"The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."
That should be clear enough but, evidently, it is not clear to the vast majority of those who sit in the Congress.
"The powers delegated by the proposed Constitution to the federal government are few and defined. Those which are to remain in the State governments are numerous and indefinite."
-- James Madison, Federal No. 45, January 26, 1788
If we are to accept that the powers of the federal government are "numerous and indefinite" and include the right to force people to do something that they choose not to do then the federal government has the sort of power that the founders of this nation fought to eliminate. Hillary Clinton's national health care plan clearly involves a legislated power to force people to purchase health insurance. The health insurance industry has donated over a million dollars to her campaign funds. Clearly, her health insurance plan is payback for the donation and will reward the health insurance industry with untold millions of dollars in profits.
Each state has (according to James Madison) the power to institute Hillary Clinton's plan, but the federal government is prohibited by our Constitution from doing it. If she wants her plan instituted, I suggest that she go to Albany, Little Rock, Tallahassee, Austin, Sacramento, and all of the other state capitals and try to get her plan instituted. In that manner she would not violate her oath of office and it would not make her a hypocrite.
Has not the time come to stop the ever expanding powers of the federal government? Has not the time come to stop those with an agenda to force us to do what they believe we should do? Has not the time come to stop our descent into tyranny? Has not the time come to put some limitations on the power of the federal government. Has not the time come to re-instate our Constitution? Has not the time come to stop electing socialists like Hillary Clinton who would regulate every facet of our lives. I suggest that we start looking around for those people who will abide by their oath of office and abide by the limitations placed on them by our Constitution.

Post a CommentHere's the answer, "NOBODY" is tasked with "INTERPRETTING" our Constitution. The fact that the Supreme Court, in "Marbury v. Madison" USURPED the power to do it and neither Congress nor the President has ever called them on it doesn't make it right. The Supreme Court is tasked with applying our Constitution to the cases that come before them, not "INTERPRETTING" it.
i will give you a hint "Marbury v. Madison"
what entity is tasked with interpreting the constitution?
Evidently you can't read, or somebody has given you a bastardized version of our Constitution, bruiser. What it says is, "To regulate Commerce with foreign Nations, and among the several States,...." I certainly see NOWHERE where it says "affects." Sorry bruiser, you're going to have to do better than that if you're going to dispute the meanong of the particular provision of Article I.
thats fine... maybe it was the end of the "Constitution" as you see it. but i will take.
the phrase is "affects interstate commerce."
Bruiser, you clearly can't figure out that the New Deal was the (intended) End of the Constitution of the United States of America.
make the case then. because your article doesn't make it.
Also, unless you are GWB, I do not think the President can implement laws. Bills have to be started in Congress, argued on the floor, voted upon, passed from the House to the Senate and with majority of votes passed along to the President to sign it into law.
If what you are saying is she wants to make it mandatory for citizens to buy health insurance than it is one more attack against the poor, who already do not have enough money to get adequate coverage. Anyway, Hillary has said the government has to lie to the people, and in another health care related issue that the government has to make choices for the people, because "they can not make choices like that for themselves". My understanding is we are a government "of, for and by the people". Anyone who wants her elected obviously wants to it to be government versus citizen. F-ed up.
