There are many reasons why delinquent parents fail to pay child support even after they have been ordered by the court to do so. These reasons can range from unemployment, denial of paternity, to downright spite over not paying the custodial parent a dime, although the purpose of child support is to support the child. Often it is the child that ends up suffering more than the parent. The child may often feel stuck in the middle of their parent's confusion or they may even blame themselves for the problems that are occurring.
The U.S. Department of Health and Human Services estimates nearly 70 percent of child support cases had arrears owed. There are ways for custodial parents to get help in getting the child support payments their child is entitled to. For starters, you need to make sure you have the father's correct information which includes his name, address, social security number, birth date, or a license plate to help authorities track him down. If you don't have all of this information, try to get as much as you can. This is a critical step. For those parents who are in the middle of establishing paternity, you need to take care of this as soon as possible. If the father denies paternity and you don't get a court order for him to take a paternity test, you're not going to be receiving any child support payments if he has not signed the child's birth certificate stating that he is the father. Child support payments cannot be collected without a court order. Check the laws in your state to find out what steps you have to take.
For those parents who are making child support payments but are upset because they're not getting visitation rights, it's important to understand that all custodial issues must be handled in the court as well. While some parents are able to work out custody and visitation agreements on their own, there are many who can't come to an agreement on this issue. For those parents who can't agree on custody, you must have a court hearing to establish the custodial arrangements. Some parents may fail to adhere to the arrangements or feel like they've been slighted if they don't get to spend as much time with the child as they'd like. This is something that should really be worked out among the parents in a way that makes it as easy as possible on the child. If the custodial changes are the result of a divorce, things are going to be hard enough on the child already without the parents bickering back and forth.
For more resources on how to collect child support payments and find out what rights you have as a parent, you can always visit your local library. They have many books and information which can be of great assistance to you. Also, it can be very beneficial to search on the internet. If you're not sure where to start, the librarians should be able to help you. In more extreme cases, you may find it favorable to hire a lawyer to explain things to you. It's important to know your rights and know what kind of support your child is entitled to. It is possible to have wages garnished or checking accounts seized to cover child support payments. Child support payments can include expenses for the child's medical and dental care, daycare, camp, or other activities for your child that you may not think are covered. In addition to knowing what you're entitled to, you must also remember to be sure to regularly renew your court order.
In many child support cases, people feel as if their files just get lost in the stack and they are getting the runaround. That's why it's important for you to stay in touch with your caseworker. Make sure they know your name, keep accurate notes for yourself, write letters to them, and make sure you keep a paper trail so you know where your case stands. Being persistent is the only way you're going to be able to stay on top of things.
Something very important all parents should remember to never do is to put their child in the middle of such situations. Don't use your child as a pawn to get back at his or her parent. Just because you make no longer be in a relationship with this person doesn't mean the child shouldn't be allowed to have a relationship with his or her parent. (Unless it is a case of abuse or where you have evidence that the child will be in danger, which you should bring up in court to help your argument). However, if you're not worried that the parent will do anything to harm the child, don't cause a rift in the child's relationship with their other parent.
When in a battle over collecting child support, you have to realize that nothing happens overnight. Some of these cases go on for months or years. And unfortunately, some of them are never resolved. There have been several cases where the custodial parent never saw a dime in child support and was forced to provide for their child as best as they could. For some this may mean having to get welfare assistance, work more than one job, or just do the best you can knowing that there will be some things that you won't be able to give your child. Many children miss out on vacations, material things, but most importantly, they miss out on support from both parents. If you're going to bring a child into this world, rather accidentally or planned, do right by the child and give him or her support that is needed.
