Update: Judge Tells Lindsay Lohan: "You Are Going to Jail. Period."

Jail Time Seems Certain for LiLo, Even If She Cops a Plea

On Wednesday morning, February 23, 2011, actress Lindsay Lohan appeared before Los Angeles Superior Court Judge Keith Schwartz for the second time in connection with her alleged theft of a $2,500 gold necklace from an exclusive jewelry store last month.

At this hearing, Judge Schwartz had some blunt and sobering words for the troubled starlet:

"I don't care that you're Lindsay Lohan," Schwartz told her. "If you plead in front of me, you are going to jail. Period. There may be an issue with amount of time, and that is why a judge has discretion. You will be going to jail."

A TMZ.com news story reports that Judge Schwartz plans to hear Lohan's probation violation case during her upcoming preliminary hearing. According to the TMZ.com report, if the judge thinks the weight of the evidence suggests that Lohan did, in fact, steal the necklace, he will revoke her bail and incarcerate her until her trial for grand theft comes up later this year.

During the hearing, Judge Schwartz also confirmed that Los Angeles Deputy District Attorney Danette Myers has offered Lindsay a plea deal that includes a six-month jail sentence. However, Schwartz said in open court, Lohan's attorney, Shawn Chapman Holley, is likely to reject this, or any other deal "for now," that involves jail time for the actress, because Lohan doesn't want to end up behind bars.

Most insiders think that eventually she will have to cut a plea deal because, as Judge Schwartz made clear to Lohan: "You are going to jail," even if she decides to accept a plea offer. Any deal would almost certainly mean a lighter sentence. Lohan could face up to three years in prison if she's convicted.

The 24-year old Lindsay Lohan appeared in court on Wednesday morning accompanied by her parents, Michael and Dina Lohan. They sat quietly in the front row of the spectator's section as the hearing progressed.

After the hearing, Michael Lohan spoke to reporters, telling them: "She's taking it [this case] seriously. She's very concerned about this. She realizes she takes chances. She does the right thing. She goes to AA all the time. She's always clear eyed and very focused. She's got a lot of things on her plate ... a lot of decisions to make, but she's making the right ones."

Lohan's latest legal troubles stem from the alleged theft of the high-priced necklace, on January 22, 2011, from Kamofie and Co., an exclusive jewelry store near Lindsay's home in Venice, California. According to police documents filed at the time of the incident, Lohan visited the store on that date and tried on the necklace. It was discovered missing several hours after Lindsay left. She was later photographed wearing the Pratima Sethi designed jewelry in public.

Speaking on Lohan's behalf, her attorney, Shawn Chapman Holley, denies that the actress took the necklace.

    Perhaps this will be a harsh dose of reality for Lindsay. I don't believe this judge will treat her differently than anyone else, celebrity status won't count.
