US Government Seeks to Suppress Proof of It's Fraud!

In Case # 04C 7403, the government is suing William J. (Bill) Benson in an attempt to censor his proof that the 16th Amendment was never Constitutionally ratified. In the case, the US Attorney alleges that the book that Bill Benson wrote, "The Law That Never Was" is a tax scheme that encourages people to evade paying the income tax.

"The authority of the federal government to collect its income tax depends upon the 16th Amendment to the U.S. Constitution, the federal income tax amendment, which was allegedly ratified in 1913. After a year of extensive research, Bill Benson discovered that the 16th Amendment was not ratified by the required 3/4 of the states, but nevertheless Secretary of State Philander Knox fraudulently announced ratification."

In the latest brief filed by Bill Benson's attorney it states:

"The government has accused Benson of penalty conduct for falsely telling people the Sixteenth Amendment to the United States Constitution was not ratified. The government further alleges Benson knew, or should have known, that what he was telling people was false. As one might expect from any man of integrity accused of being a liar and a cheat, Benson decided to defend his reputation and honor by establishing that he in fact is telling the truth. The government's pleadings show they are not at all interested in the facts showing Benson's speech is not false."

The brief also states:

"At the commencement of this case, Benson relied upon numerous court cases to argue that the issue of the ratification of the Sixteenth Amendment is "beyond review." Benson further argued that because the issue was "beyond review," he was saddled with an unrebuttable presumption of ratification which, according to the United States Supreme Court, violates the due process clause of the United States Constitution. In order not to deny Benson due process, the case had to be dismissed."

The government, at the same time, alleges that the evidence that Bill Benson has that the 16th Amendment was never Constitutionally ratified is false and then claims that the court is prohibited from looking at the evidence because the ratification of the 16th Amendment is "Beyond Review." I must be a some kind of dummy when it comes to legal matters because I always believed that there is nothing that is "Beyond Review" of the courts. A reasonably intelligent person would assume that by calling evidence false, the US Attorney has admitted that the evidence should be admitted and must present evidence of the claim that the evidence is false. The US Attorney maintains that the evidence that what Bill Benson says is true should not be admitted. However, We, The People, are considered too ignorant of the law and court proceedings to question them. It is evident in jury trials, because the courts refuse to allow the jury to know that they have the power, not only to judge the facts of the case, but also have the power to judge the law in the case. (Note, the case at hand is not a jury trial because the government is not trying Bill Benson on a criminal charge, but are trying to shut down his website, "thelawthatneverwas.com.")

In simple American English, the US Attorney is calling Bill Benson a liar and maintains that the "lies" that he is accusing Bill Benson of are not admissible as evidence. Bill Benson's attorney is maintaining that the case against Bill Benson should be dismissed if the court does not have the power to review his evidence because the ratification of the 16th Amendment is "Beyond the Court's Review" as that denies Bill Benson the right to defend himself.

What is most amazing about this case is the total blackout that the established media has done of the news of it. They are trying to censor it, just as the government is doing. What ever happened to the First Amendment right to a free press? It is an issue that every American would like to know about, especially on every 15th of April when they are saddled with the constitutionally suspect task of spending a great deal of time proving that the amount that they calculated as their fair [sic] share of income taxes on their 1040s is correct.

I urge everyone who reads this to contact your representatives in Congress and press them (First Amendment Right to Petition) for an answer on this case. For decades the courts have held that the issue of whether or not the income tax is Constitutional is an issue for Congress and Congress refuses to answer petitions referring petitioners to the courts. They love to "Catch 22" us to death on the matter. I have written my representatives for an answer months ago and they don't answer. I believe that Mr. Bill Benson belongs up there on a par with the founders of this nation. Doesn't anyone remember that the prime reason for the Declaration of Independence was taxes. Demand that your representatives in Congress answer.
