Virgie Arthur's Appeal Denied; Larry Birkhead and Dannielynn Can Leave Bahamas

Just as expected, a panel of judges in the custody case regarding Anna Nicole Smith's daughter, Dannielynn, has denied Virgie Arthur's appeal to keep Larry Birkhead in the Bahamas until the next court date which is June 8, 2007.

Virgie Arthur, mother of the late Anna Nicole Smith, filed an appeal motion on Thursday (April 26, 2007) against the ruling allowing Larry Birkhead to leave the Bahamas with his daughter Dannielynn. The only requirement would be that Larry would need to return to the Bahamas with Dannielynn for the June 8th hearing.

In a public hearing held today (Friday April 27, 2007), a panel of three appeal judges denied Virgie's request and gave a "go-ahead" to Larry Birkhead.

During the court session, Virgie Arthur was seen writing on a notepad using a flower-tipped pen. When asked by the Associated Press what she was writing, she replied that she was writing prayers and talking to God.

During the appeals hearing, one of the judges reminded Virgie Arthur that she has been fighting for Dannielynn as well as the remains of Anna Nicole Smith and Daniel Smith (Anna's son who passed a few days after the birth of his sister) to be moved to the United States.

Justice Emmanuel E. Osadebay firmly looked at Virgie Arthur and asked: "So what is the problem, what is the fear? The child is going to the States anyhow, no matter who gets custody."

Virgie Arthur stated that the reason for the appeal was that she felt Larry Birkhead would not return to the Bahamas for the hearing.

Now with a cleared departure from the Bahamas, Dannielynn will be able to finally get to adjust to her new life and bond with her biological family.

Larry Birkhead said that he will be leaving for his hometown in Kentucky as soon as he secures a passport for Dannielynn.

    I don't even know why she's bothering to try to gain custody of the baby (besides money). I find it horrible and absurd that she would try to do this after not having a good relationship with Anna. I am so glad for Larry Birkhead and want this saga to end soon, with him having his daughter to himself.
