Are you aware that if the Code Enforcement office comes out to a home building site to do an inspection and they do not appropriately inspect the work being done that they have only a limited liability, which basically equates to nothing? For more in depth background on this article please see my previous article entitled, Is Your New House a Safe Investment. Now these are the people who are responsible for making sure that your home is built to meet code and is safe. When Code Enforcement doesn't do their job correctly, you the homeowner, pay the price. Now in the lawsuit I have filed, the "unlicensed, but actual" builder had previously filed bankruptcy, so there was no recourse on him. The "licensed" builder refuses to make restitution for any of the damages in the home due to faulty construction. The County is pulling the Tort Claim Act which gives them only limited liability. Now in South Carolina there is no requirement for contractors to be insured, only surety bonded. So as the homeowner I seem to have no recourse on anyone in the situation. I'm simply out of a house, out all the money I put into the house in payments and what repairs I could afford to do and a big black mark on my credit for the foreclosure. I was just unable to afford the mortgage payments along with the $85,000.00 in repairs the home needed to become structurally sound. I tried to short sale it, but Countrywide refused. They left me no option but to allow it to be foreclosed on.
Once again, the government has shown us that it is only out for itself and that the citizens of this country aren't worth dirt. If the government can't be held liable for its actions then what recourse do we have? This country has been run into the ground over the last decade and only seems to be getting worse. If we let them get away with things code enforcement, where we house our children for their safety and well-being, apparently they can easily get away with all the big things they do to this country, like taking us to war, raising taxes, etc.
It is my hope that no one is put into the same situation that I was put into, with nowhere to turn for restitution. The good ole boys in South Carolina are not the most trustworthy individuals or divisions of the government. And as I've moved to another state I can see the corruption level here as well and it's absolutely appalling. This country has become "BY THE GOVERNMENT FOR THE GOVERNMENT" with no regard for the citizens who put them there.
We need to change the laws so that responsibility for their actions falls directly on them and doesn't trickle down to the people who have no control over the government and its devastating decisions.
