What If the Shoe Were on the Other Foot? A Case for Denying Sonia Sotomayor a Place on the U.S. Supreme Court

Why Are Certain Groups Allowed to Say Whatever They like but Other Groups Can't?

Today at 10:15 a.m. eastern standard time, President Obama told the American people that he had made his choice for the Supreme Court Justice. This person will be taking retiring Justice David Souter seat upon the Supreme Court. Who did the President choose? Sonia Sotomayor.

So, what is my beef with this lady who I knew nothing about until the news media released her name as a potential pick for President Obama? Well, from her statements, I believe she is an all out racist. Now, I know, I have heard the claim that someone who is a minority can't be racist. But that claim is bogus in today's world.

Anyone, no matter the color of their skin, can be a racist. However, today there seems to be those that think there is nothing wrong with speaking out about other races as long as you're not white. Let us look at the nominee for Supreme Court Justice, Sonia Sotomayor.

Back in 2001, while making a speech at the annual Judge Mario G. Olmos Law and Cultural Diversity Lecture. The speech was given in front of a crowd at the University of California, Berkeley and Judge Sontomayor made this statement: "I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn't lived that life,"

All I can say is "WOW." Where is the outrage from the media? I know that the liberal press and politicians will claims that it was taken "out of context" but it came straight from her very own mouth. Now let the liberal media put their slant on it.

It is not the first time we have seen "minorities" receive the "pass" for comments they have made. President Obama claimed his grandmother, the woman who raised him, was "just a typical white person." What happened? NOTHING! That is where my argument comes into the picture.

Had these comments been made by a white male or female, all hell would have broken loose. They would have been labeled a racist. The Rev. Al "I never met a camera I didn't like" Sharpton and Rev. Jesse "I commit adultery and have a baby out of wedlock" Jackson would have held several protests and demanded a apology immediately.

Imagine this scenario. You have two guys running for President of the United States. One is a military hero and the other had never held a real job outside being a "community organizer." OK, get the picture? Let us continue.

The community organizer is a white male and the military hero is a black male. Now stay with me people. The white male attends a racist church, where for 20 years, his preacher and mentor preached hate towards black people. I wonder if he would win the office of the President of the United States?

The answer is NO. Why? Because whites are held to different standards than minorities. If we were to make such statements, it is claimed as racism. If stated by minorities it is described as "life experiences." The double standard has to end.

Had a white, potential Supreme Court nominee, made such a statement, his career would be over, not to mention his nomination. President Obama seems to enjoy the company of racists. He can try to claim it is just not so but look at his record.

Now, President Obama picks a woman who will not judge court cases by constitutional law but by empathy for those that have "lived with the richness of experiences." We all know that white people were born with the silver spoon in their mouths. There has never been a white person who has struggled. That's what these types want you to believe.

Playing a victim will get you a long way in our country. Many people have played the victim role to get what they want. As I listened to President Obama give his speech and detail Judge Sotomayor's background, I swear I heard violins in the background.

Born in the projects of New York, her hard working mother worked two jobs to support her two kids after the death of their father. Oops, excuse me, tissue time. Maestro, start the violins again.

Its a heart tugging story and I'm glad that she made it to where she is today. However, her rich experiences should have no affect on her judging court cases on any stage.There is a reason the Lady of Justice statue wears a blindfold and holds a scale.

Justice is supposed to see no color or gender of an individual and the scale depicts fairness and balance. Judge Sonia Sotomayor has informed us, by her own words, that she will not rule in this way. She will use her own personal experiences to determine the outcome of potentially important cases.

Take the case she recently ruled on dealing with reverse discrimination. City officials from New Haven, Connecticut threw out promotional exam scores because no African Americans and only 2 Hispanic firefighters were likely to be made lieutenants or captains based on the results.

There is another scenario where we could put the shoe on the other foot and the outcome would have been very different. The white firefighters are being discriminated against but that isn't how Judge Sotomayor ruled. She ruled in favor of the city.

What would have been the result had it been black firefighters scoring higher than their white colleagues only to have their scores thrown away and seeing the promotions going to those not as qualified? We all know what the ruling would be. Racial Discrimination.

Judge Sotomayor sided with the Civil Service Board, claiming the City of New Haven "found itself in the unfortunate position of having no good alternatives," The real reason was that the city was afraid of being sued by minority groups and threw out the test score. Political Correctness at its worst.

This case is going to be decided by the Supreme Court in the near future. Judge Satomayor and the others judges were criticized for not offering an in depth analysis on the their ruling. The analysis was only a simple 6 sentence statement.

"We are not unsympathetic" to the (white firefighters) expression of frustration," claimed the panel of judges.
"The city of New Haven was simply trying to fulfill its obligations under federal law when confronted with test results that had a disproportionate racial impact." What a laugh they most have had when they put out their opinion. Justice is not blind to them. Color play a big part in this ruling.

We need to stop letting individuals receive a "pass" when they say something that is racist. No matter the pigmentation of their skin. If someone disrespects a group of individuals, it is our right to call them on it. I'm sure I will be called a "hater" or "racist" because I am speaking out on a woman of Latin descent but I do not care. I'm sick and tired of political correctness and will never let it hold me back from speaking my mind.

Hope others will follow and speak out against individuals like this. We all have different backgrounds and experiences. Our race does not allow us to claim we are better than any other particular group of individuals. Why is Judge Sonia Sotomayor getting the "pass" ?

In 1991, Sotomayor was nominated by President George H. W. Bush to a seat on the U.S. District Court for the Southern District of New York. She was the first Hispanic federal judge in New York. She was confirmed by the Senate in 1992.
