An SR-22 is a form that many high-risk drivers are required to file with their Department of Motor Vehicles. Its purpose is to verify that a driver is maintaining the state-required minimum auto insurance. If you've been ordered to file an SR-22, you need to contact your insurance agent. Once you obtain the necessary insurance, your agent will file an SR-22 for you.
There are several reasons for which a state will require an SR-22. These reasons include driving without a license, causing an accident while uninsured, DWI, DUI, reckless driving, license suspension, and license revocation.
Each state has its own rules, but only the state where the conviction took place can require you to file an SR-22. For example, Delaware, Kentucky, Minnesota, New Mexico, Oklahoma, and Pennsylvania do not have SR-22 requirements. This means that if you move from one of these states to one that has SR-22 requirements, you still won't need to file. On the other hand, once you file an SR-22 in any state, you'll be obligated to maintain the filing even if you relocate to a state that doesn't have SR-22 requirements.
Two other states, New York and North Carolina, don't require an SR-22. However, if you have an SR-22 on file when you move to one of them, it will be hard to find an insurance company that can file it for you after you relocate. If this occurs, you'll need to contact your former state's Department of Motor Vehicles for further assistance.
Depending on your state and your insurance company, you may have to pay a small fee to file an SR-22 form. Most states require high-risk drivers to have an SR-22 on file for three years. If you fail to maintain the requirements, you will lose your license.
