Why Casey Anthony was Acquitted

With the stunning news that Casey Anthony was acquitted of all charges in the death of her daughter (Casey was convicted only of lying to the police), Caylee, everyone is asking how could this happen? The answers is quite simple. The prosecution overreached.

Anyone who listened to the case clearly understands that two things.

1. Caylee Anthony was the daughter of Casey Anthony

2. Casey Anthony did not report her daughter as missing or dead for over a month.

Those two facts alone speak volumes. Any reasonable person would easily conclude that Casy Anthony had something to do with the disappearance and death of her daughter.

Unless she was mentally ill, any mother who is not a killer or a monster would report their child as missing, or dead from an accident, immediately.

The Prosecution Overreached

But the prosecution overreached in the case. They made the first degree murder charge, and the death penalty, the focus of their case, even though they didn't have the evidence to do so. The idea that Casey used chloroform to kill her daughter was a huge reach.

A much more likely explanation was that Casey used chloroform to knock out Caylee, so Casey could go out and party. She overdid it one night, and Caylee passed away.

Casey Anthony is Guilty of Something

But the jury did not convict Casey Anthony of any charge in the case, except for lying to the police. Clearly, Casey Anthony was guilty of at least child neglect and endangerment.

I mean come on, she didn't even report her daughter as missing or dead for over a month. And then it was her mother, Cindy, who actually called the police to report Caylee missing.

Jury Must Have Been Angry

So why didn't the jury find Casey guilty of any of the lesser charges relating to Caylee's death?

The jury was likely angry at the prosecution for trying this case mainly as a murder one, death penalty case. There was no way for the prosecution to prove without a doubt that Casey meant all along to kill her daughter, and planned the murder ahead of time. But that is exactly what the prosecution focused on.

So if you are a jury member and the prosecution keeps you sequestered from your life for well over a month and presents you a case without conclusive evidence of what they are mainly seeking, what do you do?

You tell the prosecution where they can go, and acquit the defendant in the case.

What the Prosecution Should Have Done

The prosecution should have charged Casey Anthony with much lesser crimes, and then proven those crimes. I mean not reporting your child as missing or dead for over a month is a crime. And Casey Anthony is now basically walking away from this case a free woman.

The blame for that belongs squarely on the prosecutors for trying an overly long case, and reaching for a verdict they did not have the evidence for.

Because prosecutors overreached in the Casey Anthony trial, a mother who did not report her child as missing or dead for over a month will walk away a free woman.
