A woman from Fairview Heights, Illinois filed a lawsuit Dec. 20, 2007 in St. Clair County Court regarding her involvement in an auto accident. Sydney Bender is listed on the complaint as both the plaintiff, on the behalf of her son, as well as the defendant . The complaint seeks $50,000 dollars in damages for her sons' present and future medical costs.

According to the lawsuit, Sydney Bender was making a left turn when Jeffrey Scott, while driving his ambulance, struck her automoblile. Her son, Nathan, was one month old at the time and a passenger in the car. He suffered a permanent head injury as a result of the accident. Mr. Scott, an employee of Mission Care of Illinois, is named as the other defendant. The driver, and the ambulance company, are being blamed for the drivers' excessive speed. The complaint states that Mr. Scott , of Madison County, "negligently and carelessly caused his ambulance to strike plaintiffs' car."

Sydney Bender names herself as a defendant in the lawsuit in order to collect a settlement for her son's injuries. In the complaint, Bender has stated that she failed to stop, swerve or otherwise attempt to avoid the accident with the ambulance. The mother has to admit partial fault for the accident in order to recieve any type of award. The accident occured two years ago in Fairview Heights, Illinois.
